JUSTICE SANJAY PRIYA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Ahiyapur P.S. Case No. 777 of 2018 instituted for the offence under Sections 419, 420 and 120(B) of Indian Penal Code.

Counsel for the petitioner submits that petitioner is in custody since 22.07.2018. It has been submitted that earlier, prior to declaration of result, no objection was raised by the authority that petitioner has not participated in the P.T. examination. Such objection was raised for the first time when the petitioner went to join service. Petitioner has himself participated in the P.T. examination. Nobody else in place of him has participated in the P.T. examination.

In the written report there is allegation that petitioner

Patna High Court Cr.Misc. No.55478 of 2018 (3) dt.08-10-2018 2/2 went to join service, then on enquiry, it was found that his left thumb impression and height did not match with the particulars recorded in the P.T. examination.

Petitioner is said to be in custody since 22.07.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 777 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
