Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 328,34 of the Indian Penal Code.
Allegation is that the petitioner committed murder of his wife for family dispute by administering poison to her. The wife of the petitioner was mother of three sons. Submission is that there is no eye witness of the occurrence that the petitioner administered poison to wife. The viscera report would reveal that pesticide was found. Considering the fact that there is no direct evidence against the petitioner, let the petitioner, above named, who is in custody since 01.05.2018, be released on bail on
Patna High Court CR. MISC. No.52982 of 2018(5) dt.09-04-2019 2/2 furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chautarwa Police Station Case No.76 of 2018 subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
