At the very outset, learned counsel for the petitioners submits that petitioner no.1, namely, Amit Sinha has been arrested during the pendency of this application. Hence, he prays for withdrawal of the application.
Accordingly, this bail application is dismissed as against petitioner no. 1, above named.
So far as petitioner no.2 namely Sudhakar Sinha is concerned, he apprehends his arrest in connection with Chanan P.S Case No. 26 of 2020, registered for the offences under Sections 447, 341, 323, 307, 504 and 506/34 of the Indian
Patna High Court CR. MISC. No.39865 of 2020(3) dt.01-12-2021 2/2 Penal Code.
It is submitted on behalf of petitioner no.2 that the occurrence took place due to land dispute and there is case and counter case from both the sides. Both the parties have suffered injuries and allegation against petitioner no.2 is that he assaulted Sunil Kumar with lathi, who has sustained simple injuries on his body.
Considering the aforesaid facts, let petitioner no.2, above named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. 1st, Lakhisarai in connection with Chanan P.S. Case No. 26 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Sandeep Kumar, J) pravinkumar/- U
