The petitioner apprehends his arrest in Beur P.S. Case No.97 of 2019 registered under Sections 307, 386 and other sections of the Indian Penal Code and under Section 27 of the Arms Act.

The informant disclosed that on 03.03.2019 he was going towards Mahaveer Colony along with his brother and friend. His brother and friend began to take golgappa but in the meantime the petitioner and other accused persons came on three motorcycles armed with pistol, iron rod and stick. The accused persons asked the informant why he did not pay extortion and started assaulting the informant. One Chandan fired causing injury to the informant.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.41032 of 2019(2) dt.03-07-2019 2/2 similarly situated co-accused persons have already been granted anticipatory bail by learned Sessions Judge in A.B.P. No.2059 of 2019 but the prayer for bail of the petitioner was rejected by learned Sessions Judge.

It appears that petitioner and others had gone to realise the extortion and assaulted the informant. During course of assault, Chandan also fired causing firearm injury to the informant.

Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
