JUSTICE SATYAVRAT VERMA ORAL ORDER 23-02-2022 Heard learned counsel for the petitioner and Shri Anand Mohan Prasad Mehta, learned A.P.P. for the State. The petitioner seeks bail in connection with Saraiya P.S. Case No. 64 of 2021 instituted for the offences under Sections 414 and 34 of the Indian Penal Code read with Sections 20 and 22 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.01.2021, charge-sheet has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that allegation is of recovery of 500 grams of opium along with a country-made pistol from the possession of the petitioner. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner and submits that though the recovery of opium is less than the commercial quantity but definitely it is much more than the small quantity and further the petitioner also has criminal antecedent.

Considering the submissions made by the learned A.P.P. for the State, the Court, for the present, is not inclined to grant bail to the petitioner. His prayer for bail is thus rejected. (Satyavrat Verma, J) Rishi/- U T
