2. The petitioner apprehends his arrest in connection with Gaurichak P.S. Case No. 322 of 2022 registered for the offence punishable under Sections 341, 323, 504, 307, 379, 447 / 34 of the Indian Penal Code.

3. As per prosecution case, accused persons including the petitioner assaulted the informant and his family members. Co-accused Bhola Paswan and Naresh Paswan assaulted the husband of the informant with iron rod causing injury to him.

4. Learned counsel for the petitioner submits that petitioner is innocent, committed no offence and has falsely been implicated in this case. The present case is the counter blast of the of Gaurichak P.S. Case No. 321 of 2022 registered

Patna High Court CR. MISC. No.43201 of 2023(2) dt.04-08-2023 2/2 against the informant and others filed by the defence side. Petitioner is not the assailant of the injured. The petitioner has no criminal antecedent.

5. Learned APP for the State opposed the prayer for anticipatory bail.

6. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of the learned A.C.J.M.-VI, Patna City in connection with Gaurichak P.S. Case No. 322 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
