2. The petitioners apprehend arrest in connection with Maner P S Case No. 839 of 2023 dated 24-11-2023, instituted under Sections 147,148,149,341,323, 354B, 379,307, 337, 504 and 506 of the Indian Penal Code.

The prosecution case, in short, is that on 23.11.2023 at around 9:00 A.M., the FIR named accused persons, armed with deadly weapons, entered the informant's house and started abusing and assaulting the family members. Petitioner No.6, namely Sanjay Rai allegedly pointed a pistol at the informant while petitioner no.5, namely Lal Babu Rai, fired from pistol. Female members were allegedly assaulted and their modesty outraged, and several persons, including the informant, were injured with iron rods. The accused persons also looted jewellery, cash, clothes, and destroyed household items. Based on the written application, FIR was lodged and investigation commenced.

4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in the present case. It is submitted that the FIR has been lodged against 13 named accused persons, including the petitioners, along with 15 unknown persons. Specific allegation of assault has been attributed only against petitioner no.3, namely Bhola Rai, who is alleged to have assaulted the informant's wife on her hand with an iron rod, though the injury suffered has been opined to be simple in nature. So far as petitioner nos. 1, 2, and 4 to 11 are concerned, the allegations against them are general

It is further submitted that both parties are close-door neighbors and the occurrence arises out of a petty dispute. Lastly, it is submitted that all the petitioners have clean antecedents except petitioner no.9, namely Kamesh Rai, against whom only one criminal case is pending, in which he has already been granted bail.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Danapur, Dist. Patna, in Maner P S Case No. 839 of 2023, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita 2023.

7. The application stands allowed.
