The petitioner seeks bail in anticipation of his arrest in connection with Hajipur Sadar P.S. Case No. 335 of 2020, dated 03.06.2020, instituted for the offences under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. In view of the fact that the petitioner was earlier made accused in a case of similar nature, this Court is not inclined to exercise its discretion for grant of anticipatory bail

Patna High Court CR. MISC. No.38587 of 2020(2) dt.17-04-2021 2/2 to him.

The prayer for grant of anticipatory bail of the petitioner is, accordingly, rejected.

However, if the petitioner surrenders before the Court below and seeks bail, the Court below shall consider the case on its own merits, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
