For the Petitioner/s : Mr. Shivendra Prasad For the Opp. Party/s : AC to SC - 12 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 5.
31-01-2017 Heard Sri Shivendra Prasad, learned counsel for the petitioner and learned A.C. to Standing Counsel - 12. The present petition has been filed with a prayer to restore C.W.J.C. No. 3195 of 2008, which stood dismissed long back on 20-10-2011 due to non-prosecution.
The present restoration petition was filed on 03-09-2013 and thereafter, when the matter was listed before the Lawazima Board, there was non-appearance. Though reason for non-appearance on the date when the writ petition was dismissed, has been assigned, no plausible explanation has been given for filing this restoration petition at such belated stage. Accordingly, I do not find any ground to accept this
Patna High Court MJC No.4632 of 2013 (5) dt.31-01-2017 2/2 petition.
The restoration petition stands dismissed.
