JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-09-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Complaint Case No. 1251(C) of 2015, for the offences under Sections 467/468 of the Indian Penal Code. When I was inclined to dispose of this application in the light of this Court's decision, in the case of Salim Ansari @ Md. Salim Ansari and Others v. The State of Bihar, reported in 2015 (3) PLJR 807, learned Counsel for the petitioner has caused undue obstruction and kept on insisting that this Court should decide this case on merits of allegation made in the complaint petition. Considering the attitude of learned Counsel for
Patna High Court Cr.Misc. No.37275 of 2016 (2) dt.20-09-2016 2/2 the petitioner, this application is dismissed. The petitioner, Shatrughan Yadav, is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
