2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 147, 148, 149, 160, 504, 506, 337, 307 of the Indian Penal Code.
3. As per allegation in the FIR, petitioner along with other co-accused persons have created hindrance by pelting stones to the police party in discharging the official duty while they have gone to pacify the matter of communal altercation.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. General and omnibus allegations have been levelled against him. He was only a member of the mob.
Patna High Court CR. MISC. No.43341 of 2023(2) dt.21-07-2023 2/2 Section 307 IPC is super addition in the present case due to high handedness of police officials because no one has received injury. Petitioner is languishing in judicial custody since 16.04.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM 1st Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S. Case No. 19 of 2020.
