ANJANA MISHRA ORAL ORDER 25-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as learned counsel appearing on behalf of the informant. The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 307/120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioners submits that the sole allegation is against one Nagit Alam and not against these petitioners and they have been named in the First Information Report as conspirators to the occurrence.

Learned counsel for the informant, however, submits that later on it has come that these petitioners had participated in the occurrence.

No.47285 of 2015 (3) dt.25-02-2016 P2/2 However, taking into consideration, the statements made in the First Information Report and that these petitioners have no criminal antecedent, let the petitioners, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Azam Nagar P.S. Case No. 163 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
