Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.

The prosecution case is that the dacoity being committed in the running train, F.I.R. was lodged against unknown persons under Sections 395, 397 of the Indian Penal Code. The name of the petitioner and others sprang up during investigation as the persons who were found roaming around the Banshipur Railway Station.

It is submitted by the learned counsel for the petitioner that though the case was registered in 2009, but since the petitioner was not named and the petitioner was not

Patna High Court Cr.Misc. No.35694 of 2016 (2) dt.01-09-2016 aware about involvement in the present case. It appears that only on suspicion the petitioner has been roped in the present case. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Jhajha Rail P.S. Case No. 47 of 2009, pending in the court of learned Railway J.M., Kiul.

With this observation this application is disposed of.
