2. The petitioner has preferred this application for grant of regular bail in connection with Manigachhi P.S. Case No. 36 of 2025 dated 21.03.2025 registered for the offences punishable under Sections 126(2), 115(2), 109(1), 74, 303(2), 352, 351(2) read with Section 3(5) of B.N.S.
3. As per the prosecution case, the petitioner along with the co-accused persons is alleged to have abused and assaulted the informant and his family members brutally with intention to kill and also outraged the modesty of the sister of the informant. It is further alleged that the accused persons

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. There is case and counter-case between the parties. It is further submitted that due to previous enmity, both the parties indulged into fierce fight in which petitioner and the co-accused persons might have caused some injury to the informant's side which was in self defence without any intention. There is general and omnibus allegation against the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has one criminal antecedent in which he is on bail as stated in para 3 of the bail petition. The petitioner is in custody in this case since 23.03.2025.

Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that the specific allegation of assaulting on the head of the informant's brother Pappu Yadav with iron rod is against the petitioner and the injury is stated to be grievous in nature. It is further submitted that the anticipatory bail application of the co-accused persons have been disposed of by the Co-ordinate Bench of this Court vide order dated 09.07.2025 passed in Cr. Misc. No. 40998 of
Patna High Court CR. MISC. No.44971 of 2025(2) dt.06-08-2025 3/3 2025.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Darbhanga in connection with Manigachhi P.S. Case No. 36 of 2025.
7. The application stands allowed.
