The following reliefs have been sought by the petitioner in the present writ application:- "1 (i) For issuance of an appropriate writ/s, order/s, Direction/s to respondents for quashing decision dated 19.03.2026 of the respondent no. 5 whereby and whereunder technical bid of the petitioner has been rejected and it has been declared ineligible for NIT No. 05/2025-26 which has been
Patna High Court CWJC No.9762 of 2026(2) dt.13-07-2026 2/3 invited for Selection of Agencies for providing Outsourced Manpower for performing and Managing Day to Day Activities related to sanitation work for Nagar Panchayat, Madhopur Susta.
(ii) For issuance of an appropriate writ/s, order/s, Direction/s to the respondents to consider and declare the petitioner successful in technical bid and thereafter open financial bid of the petitioner so that healthy competition may be done in the NIT No. 05/2025-26 wherein only one company has been declared successful alongwith dummy company of the successful company namely Pratap Sewa Sankalp.
(iii) For issuance of an appropriate writ/s, order/s, Direction/s to the respondents not to open financial bid of so-called successful bidder and during pendency of the present writ petition, the work order should not be given to the company which has been declared successful in meeting of technical bid committee.
(iv) For issuance of an appropriate writ/s, order/s, Direction/s to the respondents to hold an enquiry with regard to rejection of technical bid of the petitioner that how the technical bid has been rejected on flimsy ground of none matching of name of the agency and the GST registration No. made in the name of said agency though in other districts of the State same agency is doing other works on the same documents which has been filed and uploaded in this NIT No.
05/2025-26.
(V) To pass such other order/orders as your Lordships may deem fit and proper in the facts and circumstances of this case."
3. Learned counsel for the respondents submits that the tender process has already attained finality as the work order has been issued on 25.05.2026, pursuant thereto, an agreement
Patna High Court CWJC No.9762 of 2026(2) dt.13-07-2026 3/3 has been executed between the parties and the work is presently in progress. In support of the said submission, a copy of the work order dated 25.05.2026 has been produced before the Court, which is taken on record and marked as 'X'.
4. In view of the aforesaid statement, this Court is of the view that the present writ application has become infructuous.
5. Accordingly, the present writ application stands disposed of as having become infructuous.
6. Pending application (s), if any, shall also stand disposed of.
