The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 341, 323, 324, 504, 506/34 of the Indian Penal Code. Later on, section 307 of the Indian Penal Code.

As per the prosecution case, on the alleged date and time of occurrence all the accused persons named in the FIR including petitioner having variously armed arrived at the courtyard of the informant and assaulted the informant. Coaccused Rabiul assaulted the nephew of informant by Farsa and co-accused Sk. Mojib assaulted the informant by sword causing head injury.

Patna High Court CR. MISC. No.42619 of 2022(2) dt.01-12-2022 2/2 It is submitted that there is no specific allegation of assault against this petitioner. Petitioner is a lady having clean antecedent.

Counsel for informant however vehemently opposed the prayer for bail.

Considering the facts aforesaid, the petitioner abovenamed, in the event of her arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Amdabad P.S. Case No. 264 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
