JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-05-2022 Heard Mr. Paras Nath, learned advocate for the petitioner and Mr. Shailendra Kumar Singh, learned Additional Public Prosecutor representing the State.
The petitioner seeks bail in connection with Sessions Trial No. 180 of 2021/83 of 2021 arising out of Alipur P.S. Case No. 37 of 2020 dated 08.06.2020 instituted for the offences under Sections 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner has not been named in the F.I.R. and his complicity in this case has surfaced only during investigation of the case on the confession of an arrested accused person.
A similarly situated accused person has been granted bail by a coordinate Bench of this Court vide order dated
Patna High Court CR. MISC. No.53059 of 2021(2) dt.25-05-2022 2/2 20.05.2021 passed in Cr. Misc. No. 1962 of 2021. The petitioner is in custody since 12.06.2020. It has been submitted on behalf of the petitioner that there has not been any substantial progress in the case before the court below.
This Court also notices the fact that in two cases in which the petitioner was earlier made accused, he is on bail. Considering the aforenoted facts and specially the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Alipur P.S.
