This application for anticipatory bail arises out of Buddha Colony P.S. Case No. 435 of 2018 for the offence punishable under Sections 147, 148, 149, 188, 341, 323, 325, 332, 333, 337, 338, 353, 427, 449, 450, 451, 452, 461 and 120B of the Indian Penal Code and Section 3/4 of the Damage to Public Property Act.

There are 167 persons named in the First Information Report. The occurrence had taken place in the Police Lines, where the trainee constables were agitating against the death of a co-trainee because of the alleged improper look after of her health issues.

Learned counsel appearing on behalf of the petitioner has, referring to an order, dated 01.07.2019, passed in Cr. Misc. No. 40237 of 2019, whereby similarly circumstanced

Patna High Court CR. MISC. No.44514 of 2019(2) dt.19-07-2019 2/2 co-accused, Raj Kishore Yadav, has been allowed anticipatory bail.

Considering the above, this application is allowed. Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-XVI, Patna, in Buddha Colony P.S. Case No. 435 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
