Petitioner prays for bail in connection with Mahnar P.S.Case No. 137 of 2018 registered for the offences punishable under Sections 147. 148, 149, 341, 323, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the accused persons, including the petitioner is that they came near the place of occurrence having armed with weapons and started firing indiscriminately and specific allegation of firing is against Hemant Kumar and allegation against Madan Singh and other accused persons is of assault to the informant by rod.

Submission of learned counsel for the petitioner is that FIR itself shows that allegation of firing by which Rahul Kumar has received injuries is against Hemant Kumar and

Patna High Court Cr.Misc. No.55115 of 2018(3) dt.31-10-2018 2/2 allegation of assault is against accused Madan Singh and others. Petitioner is in custody since 25.6.2018 and co-accused Madan Singh has been granted bail by a co-ordinate Bench of this Court vide order dated 20.9.2018 passed in Cr.Misc.No. 57446 of 2018 and charge sheet has been submitted in this case. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Vaishali at Hajipur, in connection with Mahnar P.S.Case No. 137 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
