2. The petitioner seeks regular bail in connection with Bettiah Muffasil P.S. Case No. 616 of 2024 registered for the offence under Sections 308(2), 316(2), 318(4), 338, 336(3), 340(3), 119(1), 352, 351(2) & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The case of the prosecution is that one Rajeshwar Singh has sold 4.69 decimal of land to the informant on 24.05.2023. On 05.10.2024, when the informant went on his land, he found that the accused persons were collecting construction material over his land. He came to know that Rajeshwar Singh has executed a sale-deed in favor of the

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 09.05.2025. He also submits that actually the petitioner is the victim because the land was sold to him without being informed that earlier it was transferred, fraud if any, has been committed by Rajeshwar Singh, who was having the knowledge of previous sale-deed.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran/concerned Court below in connection with Bettiah Mufassil P.S. Case No. 616 of 2024.
