JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Katoria P.S. Case no. 11 of 2017, registered under Sections 367 of the Indian Penal Code.
The accusation is that there was no good relation of the informant with her husband Dinesh yadav due to that reasons she used to reside at her Myaka along with her child. On 28.01.2017, cousin brother in law Dilip Yadav came at her Myaka thereafter her husband Dinesh Yadav took her at her matrimonial house on 28.01.2017. Her cousin brother in law called to some unknown at the house, where she was called by her husband. Thereafter, Dinesh Yadav, husband of the informant, told that his sister is serious and asked her to accompany him for going to Sasural of his sister. Thereafter, she proceeded along with her husband. In the way, one Auto rickshaw came in which Baldeo Yadav and Quayum Miyan and five others were present, which was driven by Dinesh Yadav. No.39598 of 2017 (4) dt.12-12-2017 2/2 powder on her and she became unconscious and when regained consciousness she found herself in the train, where five unknown persons were present. She anyhow moved towards toilet on the pretext to attend call of nature and informed her mother on mobile. When she returned then her mobile was snatched. She was taken at Lucknow on raising alarm, she was informed that she has been sold by Dinesh Yadav, Baldeo Yadav, where she was managed to met with daughter of Baldeo Yadav and she was left at her Myaka on 03.09.2017. Learned counsel for the petitioner submits that petitioner is the cousin brother-in-law of the informant. It would appear from the F.I.R. that he has no concerned in accompanying the informant and selling her and he has falsely been implicated in this case. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Banka in connection with Katoria P.S. Case No. 11 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
