JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-09-2019 Because of the earlier order of this Court, though most of the retiral dues of the petitioner have been paid, however, it is informed by the learned counsel for the petitioner that 10% amount of pension and gratuity are still remaining to be paid. Per contra, the learned counsel for the respondents, referring to Annexure-G to the counter affidavit, has submitted that the petitioner has not given the quarter vacation report, the order of posting of the petitioner from Rajkiya Mahila Shikshak

Patna High Court CWJC No.13172 of 2019(4) dt.09-09-2019 2/2 Prashikshan Mahavidyalay, Ranchi to the Education Department and the pension acceptance paper in three copies. This Court finds that the aforesaid requirements are wholly unwarranted and the same is only a ploy to harass the petitioner, hence, the respondents are directed to pay the balance 10% amount of pension and gratuity to the petitioner within a period of four weeks from today, failing which the Director, Library and Information Center, Bihar, Patna shall not draw his salary.

At this stage, the learned counsel for the petitioner submits that there are some other grievances of the petitioner like non-payment of arrears of salary, non-payment of benefits of ACP/ 2nd ACP and non- grant of benefits of pay revision. For the aforesaid grievances, the petitioner is granted liberty to approach the respondent authorities so that the authority can redress his grievances within a period of eight weeks from the date of receipt of representation, to be filed by the petitionerr.

The writ petition stands disposed of on the aforesaid terms.
