2. The petitioner is apprehending his arrest in connection with Ganga Bridge P.S. Case No. 35 of 2023 registered for the offences punishable under Sections 392 of the Indian Penal Code.

3. As per prosecution case, motorcycle, mobile, cash and other papers of the informant were looted by three unknown miscreants when he was returning to his home.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case and there is no recovery made from possession of the petitioner. The name of the petitioner transpired during the

Patna High Court CR. MISC. No.45321 of 2023(2) dt.30-08-2023 2/3 investigation in the confessional statement of the co-accused Raju Chaudhary and Gokhul Kumar. He further submits that on disclosure of the co-accused one another case has also been registered against the petitioner. Petitioner is a student of B.B.A. at L.N. Mishra Institute and he has no concern with the coaccused persons.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Ganga Bridge P.S. Case No. 35 of 2023, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, subject to the conditions as follows:

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
