1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115, 118(1), 109, 352, 351(2), 3(5) of the BNS, 2023.
3. Learned counsel appearing on behalf of the petitioners, after some arguments, seeks permission to withdraw the anticipatory bail application with respect to petitioner No. 1 Garbhu Thakur.

4. Permission is accorded.
5. It is next submitted that informant alleges that on 17.01.2026 at 11:00AM he was going to see his field when he was intercepted by 14 named accused persons including the petitioners near his field who were waiting from before and Garbhu assaulted him by farsa causing on head and Sanjay assaulted by kudal causing injury on right leg, thereafter Sikendra along with other accused persons assaulted his brother by lathi and he became unconscious while Manoj dashed his wife on the ground, but on intervention of villagers, they were saved.

Learned counsel appearing on behalf of the petitioners submits that petitioners have been falsely implicated in the instant case by the informant, it is next submitted that on account of dispute relating to land, the occurrence is alleged to have taken place, it is also submitted that no specific allegation of assault is alleged against petitioner nos. 2,3 and 5 though petitioner No. 4 Sikendra is alleged to have assaulted the brother of the petitioners, but then it is submitted that it is not alleged specifically against Sikendra rather informant alleges that Sikendra along with other accused persons assaulted his brother by lathi causing injury, as such, allegation of assault is not
Patna High Court CR. MISC. No.45350 of 2026(2) dt.13-07-2026 3/3 specific, it is next submitted that no doubt injury on head has been opined to be grievous in nature, but then the allegation of assaulting the informant on head is against Garbhu.
7. Learned A.P.P. for the State opposes the anticipatory bail application of the petitioners.

Considering the submissions made by the learned counsel appearing on behalf of the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kishanpur P.S. Case No. 18 of 2026 subject to the conditions as laid down under Section 482 (2) of the BNSS.
9. The application stands allowed.
