Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.
The petitioner seeks regular bail in connection with Supaul P.S. Case No. 713 of 2021 lodged under Section 394 of the I.P.C.
As per the prosecution case, the F.I.R. has been lodged against 4 unknown criminals against whom the allegation of committing dacoity of cash Rs.8,91,171/- and 29 mobiles is there. The allegation is there that they have also taken DVR of C.C.T.V.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R., his antecedent is clean and
Patna High Court CR. MISC. No.43927 of 2022(2) dt.23-12-2022 2/2 he is in custody since 05.11.2021. Learned counsel also submits that the other co-accused persons of this case have been granted bail by the Co-ordinate Bench of this Court.
Learned counsel for the State opposes the prayer for bail and submits that once bail shall be granted, the petitioner shall start making delay in the trial.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions JudgeIInd, Supaul in connection with Supaul P.S. Case No. 713 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.( If the learned Court Below comes to a conclusion that petitioner after his release, is trying to delay the trial in any manner, learned Court Below shall forthwith cancel his bail bond after recording the said reasons.) With this observation, the bail application stands allowed.
