The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 447, 302, 323, 354, 506 and 34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners have antecedent of one case which was also instituted from the side of the present informant. It is further submitted that from perusal of the allegation as alleged in the
Patna High Court CR. MISC. No.53673 of 2021(2) dt.05-07-2022 2/2 F.I.R. it would manifest that the allegations are general and omnibus in nature and the occurrence took place on account of land dispute. Learned counsel submits that the petitioners and informant are agnates and as such the informant has implicated them without leveling any specific allegation against them. It is further submitted that co-accused Jeetu Mahto and Rakesh Mahto have been granted regular bail by this Court. At this stage, learned counsel for the petitioner seeks permission to withdraw the present anticipatory bail application with liberty to the petitioner to move before the learned court below for seeking regular bail.
Permission is accorded.
If the petitioners surrender in the learned court below by 22.07.2022, the learned court below shall try to dispose of the case on the same day keeping in mind the fact that similarly situated co-accused have been granted regular bail by this Court. (Satyavrat Verma, J) Rishi/- U T
