2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 304B/120B of the Indian Penal Code.

3. As per prosecution case, informant's daughter was married to this petitioner in 2021. Later on, petitioner started subjecting her to torture and harassment for non-fulfilment of demand of dowry. On 1.8.2021 informant got information that her daughter is serious and when she went to her matrimonial house, she was found lying dead with black mark around the neck.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case since he happens to be husband of deceased. Allegation is general and omnibus and no specific overt act has been alleged against this petitioner. As a matter of fact, informant's daughter died during treatment in hospital due to chest pain. Post mortem report reveals that there was no external injury on the body of the deceased and death occurred due to cardio respiratory failure. Charge has already been framed in the case on 30.4.2025. Petitioner is in custody since 19.2.2025.

5. Learned counsel for the State and the informant oppose the prayer for bail.

6. Considering the aforesaid facts of the case, materials collected during investigation and period of custody of the petitioner, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Kishanganj in Sessions Trial No. 90/2025.
