2 The petitioner has preferred this application for grant of regular bail in connection with Taraiya PS Case No 422 of 2021 dated 23.12.2021 registered for the offence punishable under Sections 341, 323, 504, 366A/34 of the IPC. 3 As per the prosecution case, the petitioner and the co-accused persons are alleged to have kidnapped the informant's sister from his house forcibly.
4 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has one antecedent, as stated in paragraph 3 of the bail petition in which he is on bail. It is further submitted
Patna High Court CR. MISC. No.43079 of 2023(2) dt.19-07-2023 2/2 that the petitioner has been made accused in this case only because he is the father of the co-accused Sonu. The petitioner is in custody in this case since 29.01.2023.
5 Learned APP has vehemently opposed the bail petition of the petitioner.
6 Considering the aforesaid facts and circumstances of the case, the period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of ACJM I, Saran at Chapra in Taraiya PS Case No 422 of 2021 dated 23.12.2021. 7 This application stands allowed.
