JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2019 This is an application for grant of anticipatory bail in connection with Chowk P. S. Case No. 128 of 2019, disclosing offences under Sections 307/34 of IPC and Section 27 of the Arms Act.

As per the F.I.R. allegation against the petitioner is of firing upon the son of the informant, causing fire arm injury. Submission of the learned counsel for the petitioner is that the allegation is false and concocted. While the informant has herself stated that petitioner has filed an application before the C.J.M. that petitioner has not fired, as such, he has falsely been implicated in this case.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that witnesses during the investigation has supported the allegation against the petitioner

Patna High Court CR. MISC. No.42864 of 2019(4) dt.26-09-2019 2/2 and injured has also named this petitioner.

Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by order of this Court.
