This is an appeal under Section 14(a)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter in short referred to as the 'SC/ST Act), against the refusal of prayer of anticipatory bail vide order dated 15.01.2021 passed by learned 1st Additional Sessions Judge-cum-Special Judge (PoA Act), Darbhanga in
Patna High Court CR. APP (SJ) No.3676 of 2021(3) dt.21-06-2023 2/2 connection with Baheri P.S. Case No. 273/2020 registered under Sections 147, 148, 149, 341, 448, 380, 427, 436 and 504 of the Indian Penal Code and Section 3 (1)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. By the order dated 08.10.2021, the appellants were granted provisional bail by the Coordinate Bench of this Court and case diary was called for.
I perused the case diary, there is no material evidence in the case diary against the appellants.
Considering the facts and circumstances of the case, the provisional bail granted to the appellants on 08.10.2021 is hereby confirmed.
Appellants are directed to not disturb the shop of the informant.
