This is an application for bail in connection with Begusarai Town P.S. Case No. 275 of 2017 registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of three children.

Submission of learned counsel for the petitioner is that boys were traceless and thereafter the case has been lodged by the police and children have been recovered. Further submission is that that victims have not made any allegation against this petitioner and petitioner has not been put on Test Identification Parade and he has falsely been implicated in this case and is in custody for three months.

Having heard both sides and considering the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Begusarai Town P.S.Case No. 275 of 2017, subject to the conditions :- (i) One of the bailors should be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (ii) Petitioner will co-operate in trial and will appear on each and every date fixed in the case and on failure to appear without any genuine reason or without permission of court, his bail bond shall be cancelled.
