JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offence punishable under Sections 419, 420, 406 of the Indian Penal Code.

As per prosecution case, this petitioner along with other Post Office staff committed fraud with the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the entire alleged money had been withdrawn by the informant herself and this submission is supported vide Annexure-3, which shows that money was withdrawn by different persons on different dates from the account of the informant. Petitioner has got clean antecedent.

Considering the aforesaid facts, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
