The petitioner is in judicial custody in connection with Katra P.S. Case No. 24 of 2021 registered under Sections 341, 448, 323, 324, 379, 504, 506, 325 and 307/34 of the Indian Penal Code.

The informant is Asha Devi and according to her the petitioner amongst other came to her place and started using abusive language. The further allegation is that he repeatedly used sharp cut weapons on her head causing injury to her. She has lastly alleged that her 'Mangalsutra' was also snatched by the petitioner.

Patna High Court CR. MISC. No.52094 of 2021(3) dt.10-05-2022 2/3 perused and the Doctor has opined the injuries to be grievous in nature.

Learned counsel for the petitioner submits that they are all agnates and due to land dispute there was fight between the parties which resulted into this occurrence. He further submits that he is 75 years old man, has already suffered and is in jail since 15.06.2021. He further submits that charge-sheet has already been submitted and as such, the same may be considered for grant of the privilege of bail to the petitioner. Since the charge-sheet has already been submitted and there is no question of tampering with the evidence; the petitioner is aged about 75 years old and he is in jail since 15.06.2021, this Court is inclined to grant him the privilege of bail but with certain conditions.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzuffarpur in connection with Katra P.S. Case No. 24 of 2021, subject to the following conditions :- (i) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of

(ii) he shall in no way try to induce or promise or threat the witnesses or tamper with the evidence, failing which the State shall be at liberty to take steps for cancellation of his bail bonds.

The bail application is allowed with the aforesaid observations.
