JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and the State. The petitioner is a P.D.S. dealer under Pauthu Gram Panchayat within Rafiganj Block of Aurangabad district. A showcause notice was issued containing the charge of black marketing etc. A criminal case was also instituted bearing Pauthu P.S. case no. 40 of 2013 dated 04.08.2013. In the aforesaid case, the police submitted final form, which was accepted by the Magistrate. The petitioner has sought quashing of the order cancelling his P.D.S. license, as he has been acquitted in the criminal case.
I find that the P.D.S. license of the petitioner has been cancelled on the charge of indulging in black marketing for
Patna High Court CWJC No.5418 of 2015 (3) dt.07-10-2015 2 / 2 which a criminal case was also instituted. As the petitioner has been acquitted in the criminal case, the impugned order cancelling the P.D.S. license is set aside.
This application stands allowed.
