JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-09-2017 The petitioner seeks regular bail in connection with Samastipur Mufassil P.S. Case No. 77 of 2017, registered for offences punishable under Sections 448, 341, 323, 354(B), 354(A), 379, 504, 506 and 307 of the Indian Penal Code. Allegation against the petitioner is of trying to outrage the modesty of the informant and also of assault to the informant. It has been submitted on behalf of the petitioner that earlier the informant has taken a huge amount from the petitioner on the pretext of giving the benefit of Government scheme in construction of his house as well as in some other works but the informant failed to provide him any benefit and when the petitioner went to demand his money back some altercation took place, for which this present false case has been filed by the

informant. Further petitioner has no criminal antecedent and has been in judicial custody since 12.06.2017.

Learned counsel for the State opposed the prayer for bail and submitted that the injuries caused to the informant in her thumb was found to be grievous in nature.

Having heard both sides, considering the facts and circumstances of the case and nature of allegation and also that injuries found on the person of informant was on left hand, which is not a vital part of the body, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VI, Samastipur, in connection with Samastipur Mufassil P.S. Case No. 77 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and

when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
