Petitioner apprehends arrest in a case registered for the offence punishable under Sections 323, 506/34 and other sections of Indian Penal Code.
As per prosecution case, Rs. 16,12,935/- was taken by the petitioner and on demand, he refused to pay it back to the informant.
Learned counsel appearing for the petitioner submits that the petitioner that the dispute and allegation of transaction between the parties is ornamental in nature. Alleged extending loan given by the informant to the petitioner is without any supporting documents. It is next submitted that cause of action arose in 2015 but FIR for the same has been lodged after a lapse of more than 7 years. Petitioner has got clean

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1st, Bhagalpur in Nathnagar P.
