2. The petitioners are apprehending their arrest in connection with Patahi P.S. Case No. 63 of 2024 (C.No. 915 of 2022) registered for the offences punishable under Sections 323, 341, 307, 504, 506 and 34 of the Indian Penal Code and Sections 25(1-b)a/26/35 and 27 of the Arms Act.

3. As per prosecution case, when the informant along with his brother and nephew were going to the house of his uncle, the petitioners along with other co-accused persons

Patna High Court CR. MISC. No.45293 of 2024(2) dt.24-07-2024 2/3 armed with lathi and garansa came there and assaulted them and made firing upon informant and his brother and nephew but anyhow they save themselves.

3. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case due to ulterior motive. The seizure list witnesses are relative of one Prabhakar Singh, who is the accused in Patahi P.S. Case No. 16 of 2024, under Sections 302, 376, 354D, 34 of the IPC and 4/6 of the POCSO Act, lodged by the petitioner no. 2, Harendra Singh. It is further submitted although there is allegation of firing made by the petitioner and assaulting the informant side but there is no injury caused to anyone. He further submits that the allegation levelled against the petitioners are general, vague and ornamental in nature. Petitioners have no criminal antecedent and they undertake to cooperate in the investigation and trial of this case.

5. Learned APP opposes the prayer for anticipatory bail of the petitioners.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days

Patna High Court CR. MISC. No.45293 of 2024(2) dt.24-07-2024 3/3 from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Patahi P.S. Case No. 63 of 2024, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
