The petitioner apprehends her arrest in Laheriasarai P.S. Case No. 424/2014, registered for the offences punishable under Section 365, 366, 366(B) and 120(B) of the Indian Penal Code. The father of the victim made allegation that Mukesh Kumar Jha kidnapped his daughter for illegal work. The petitioner is also named in the FIR.

It is submitted that the petitioner is residing in the Ahmedabad. Mukesh Kumar Jha came along with the victim and stayed one night in her house. She is the co-villager of Mukesh Kumar Jha.

The victim has given her statement under Section 164 of Cr.P.C. and she disclosed that she stayed a night in the house of petitioner, but the victim did not make any sort of allegation

Patna High Court Cr.Misc. No.30871 of 2015 (3) dt.07-10-2015 2/2 against the petitioner. Mukesh Jha is alleged to have kidnapped the victim and committed rape with her.

Considering the facts aforesaid and the fact that the petitioner is a lady, the petitioner, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No. 424/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
