The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 47(a) of the Excise Act.
16.89 litres of foreign liquor were recovered from the grocery shop of the petitioner. It is submitted by learned counsel for the petitioner that the seizure was made prior to the coming into force of the amended Excise Law. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute ground for
Patna High Court Cr.Misc. No.46158 of 2016 (2) dt.22-10-2016 2/2 consideration of prayer for bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Case No. C-7-41 of 2015 pending in the court of learned Additional Chief Judicial Magistrate 1st, Banka.
