JUSTICE SANDEEP KUMAR ORAL ORDER 15-02-2022 At the very outset, learned counsel for the petitioners submits that the name of the husband of petitioner No. 2 has been wrongly typed in the petition as 'Sunil Bind @ Sunil Mahto' whereas it should be 'Guddu Bind @ Guddu Mahto'. Learned counsel for the petitioners is directed to make necessary correction by 23rd February, 2022.

Learned counsel for the petitioners seeks permission to withdraw the present anticipatory bail application as against petitioner No. 1 (Ranjeet Bind).

Permitted to be withdrawn.

It is, thus, dismissed as withdrawn as against petitioner No. 1.

Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a

Patna High Court CR. MISC. No.52366 of 2021(2) dt.15-02-2022 2/3 period of four weeks from today.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State through video conferencing.

The petitioner No. 2 apprehends her arrest in connection with Manjhi P.S. Case No. 71/21 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

So far as petitioner No. 2 (Chanda Devi) is concerned, she is a young lady and there are general and omnibus allegations against her of having assaulted the deceased. There is only one anti mortem injury found upon the dead body of the deceased which creates doubt over the participation of the petitioner No. 2 in the killing of the deceased. Considering the facts and circumstances, the present anticipatory bail application is allowed.

Accordingly, let the petitioners above named be released on bail, in the event of her arrest or surrender before the court below within a period of ten weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-13, Chapra at Saran, in connection with Manjhi P.S.
