ANJANA MISHRA ORAL ORDER 21-12-2015 Learned counsel for the petitioners submits that since petitioner no.1 has been taken into custody the bail application on his behalf has become infructuous. As such, the bail application filed on behalf of petitioner no.1 is, accordingly, dismissed as infructuous. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner no.2 is apprehending his arrest in Sadar (Hijipur) P.S. Case No.401/15 for the offences under Sections 341, 323, 307, 504, 506,354 and 379/34 of the I.P.C. The case diary in the present case was called for has since been received.

No.50712 of 2015 (3) dt.21-12-2015 2/2 Considering the fact that the petitioner is alleged to have given lathi blow causing injury on the head of Rabindra Prasad Singh which has been found simple in nature and that he has no criminal antecedent as is evident from the case diary, let the petitioner no.2, abovenamed, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Vaishali, in Hajipur Sadar P.S. Case No.401/15 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
