In this case, the petitioner is seeking anticipatory bail in connection with Bidupur P.S. Case No. 426 of 2014 registered for offence punishable under sections 147, 148, 149, 447, 448, 423, 307, 379, 506 of the Indian Penal Code and section 25 (1-b)a, 26, 27 of the Arms Act.

The alleged offence has been committed in the year 2014 and the present application has been filed after five years, at the same time, the petitioner has a long history of the criminal case.

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and

Patna High Court CR. MISC. No.44081 of 2019(2) dt.22-07-2019 2/2 accordingly his prayer for bail is rejected. However, if the petitioner surrenders before the court below and prays for regular bail, the court below without being prejudiced by this order, will take decision in accordance with law.
