The petitioner seeks bail in Jagdishpur P.S. Case No. 209/2018, instituted for the offences under Sections 25(1-b)a and 26 of Arms Act.
It is alleged in the written report that on getting information, police party reached near Gurha Gangta Pokhar. Seeing the police party, one person having white carry bag started running away, who was arrested on chase. On search of his person, from left side of waist a pistol along with magazine and five live cartridges were recovered. It is further alleged that from the white bag, one carbine along with magazine containing ten live cartridges were recovered. From the aforesaid bag two magazines
Patna High Court Cr.Misc. No.55827 of 2018 (3) dt.08-10-2018 2/2 were also recovered in which one was that of carbine containing eleven bullets and another magazine was that of pistol containing six bullets. Accordingly, seizure-list was prepared and copy thereof was given to the petitioner.
Considering the huge quantity of arms and ammunition which is said to have been recovered from possession of petitioner, this Court is not inclined to grant bail to petitioner. Accordingly, prayer for bail of the petitioner is rejected. Petitioner is given liberty to renew his prayer for bail after six months in the event no substantive progress is made in trial.
