NILU AGRAWAL ORAL ORDER 04-11-2015 Heard learned counsel for the petitioners, Mr. Rajesh Kumar Sinha and learned A. P. P. for the State. The petitioners apprehend their arrest in connection with Jhajha P.S.Case No. 152/2015 registered for offences punishable under Sections 341, 323, 504/34 of the Indian Penal Code and Section 3(i) (x) of S.C. /S.T. (Prevention of Atrocities) Act, 1989.
The prosecution case is that the informant, Durpatia Devi stated that accused Kamdeo, Paras and Munilal Thakur was forcibly ploughing her land and Kamdeo Thakur assaulted her daughter-in-law by means of lathi. Her daughter-in-law has pregnancy of five months and she sustained hurt in her waist. Accused persons had come to her house and threatened to oust the
Patna High Court Cr.Misc. No.50953 of 2015 (2) dt.04-11-2015 2/2 informant from village and also abused her by using caste name "Domin".
It has been submitted by the learned counsel for the petitioners that the dispute is with relation to land and there is a civil suit bearing No. 140/2015 before the Court of learned SubJudge, Jamui, pending between the parties. It has further been submitted that the land dispute further is corroborated by the Informatory petition filed by the petitioners against the informant and others, who are co-villagers. Under such circumstances, let the petitioners, above named, in the event of their arrest or surrender before the Court below, within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned S.D.J.M., Jamui in connection with Jhajha P.S.Case No. 152/2015, subject to the conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
