JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-12-2021 Heard Mr. Bindhyachal Singh, the learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Rivilganj P.S. Case No. 119 of 2020, dated 13.04.2020, instituted for the offences under Sections 504, 506 and 353 of the Indian Penal Code. The learned counsel for the petitioner has submitted that, at present, his wife is the Mukhiya of the local Panchayat and because of her enemies, this false case has been lodged.

With respect to other cases listed in paragraph 3 of the bail application, it has been submitted that such cases were lodged against the petitioner while he himself was the Mukhiya and in all such cases, he is on bail. It has, therefore, been submitted that the offence remains inchoate.

Regard being had to the facts afore-stated, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of three weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Saran at Chapra in
