Petitioner is accused in connection with Spl. Case No. 6438 of 2018 arising out of Bakhtiyarpur Rail P.S. Case No. 83 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act and section 34 of the I.P.C.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Further submission is that petitioner has no criminal antecedent and is in custody since 15.07.2018.
