2. Petitioner seeks regular bail in connection with Rajauli P.S. Case No. 401/ 2024 dated 17.08.2024 registered for the offence(s) punishable under Section(s) 3, 4 and 5 of the Explosive Substances Act.

The main submissions advanced by the petitioner's counsel are that the instant matter relates to the recovery of 133 pieces of gelatin wire and 125 detonators from the reserved forest area, the petitioner has been made accused mainly on the basis of disclosure made by Forester who claimed to have identified the petitioner and other accused persons being involved in the illegal mining inside the forest area and except this, there is no material against this petitioner, in respect of the

(F) Case No. 109 of 2024 one day prior to the registration of the FIR of the present matter by the same informant in which the petitioner has got bail, so, the petitioner is presently facing two cases in respect of the same occurrence. It is further submitted that the recovery of the alleged articles is completely suspicious as in the seizure list concerned to the present matter, the date of seizure has been shown as 16.08.2024 while as per the FIR, which was registered 24 hours after the recovery, the alleged recovery was shown having been made on 17.08.2024 and the police officials and the forest officials prepared two seizure lists with regard to the same occurrence showing gap of one day which shows the high-handiness of officials of both the departments to implicate the petitioner in a false case. It is lastly submitted that petitioner is 63 year old person and languishing in jail since 15.05.2025.
4. Learned APP for the State has opposed the bail prayer of the petitioner.
5. Having considered the aforesaid submissions advanced by the petitioner's counsel, this court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be released on bail in connection with Rajauli P.S.
