Pusuant to the order dated 30.01.2023, the S.H.O. and the Investigating Officer of Samastipur Muffasil Police Station are present in Court with the records of the case. The affidavit of the S.H.O. and the I.O. have been filed and the same is taken on record.

The petitioner seeks bail in connection with Samastipur Muffasil P.S. Case No. 210 of 2022 registered for the offence under Sections 341, 342, 354(b) and 509 of the Indian Penal Code and Section 8 and 12 of the POCSO Act, 2012.

Patna High Court CR. MISC. No.42633 of 2022(5) dt.08-02-2023 2/2 Learned A.P.P. submits that the petitioner has tried to rape a 11 year old girl.

Considering the submission made by the learned A.P.P., this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer of bail of the petitioner is rejected.

The Court below is directed to expedite the trial. The personal appearance of the police officers is dispensed with.
