2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code.
3. As per prosecution case, informant's sister was married to this petitioner in 2009. Later on, petitioner started subjecting her to torture and harassment and on 18.1.2018 informant got information that his sister was killed by the accused persons by strangulation.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case since he happens to be husband of deceased. Informant is not an eye witness to the occurrence. Deceased committed suicide. Allegation is general and ambiguous and no specific overt act has been alleged against this petitioner. At the time of occurrence, petitioner was in Mumbai. Charge has already been framed in the case on 20/11/2025. Petitioner is in custody since 4.4.2025.
5. Learned counsel for the State and the informant
Patna High Court CR. MISC. No.41378 of 2025(4) dt.19-12-2025 2/2 oppose the prayer for bail.
6. Considering the aforesaid facts of the case, materials collected during investigation and period of custody of the petitioner, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 12, Motihari, East Champaran in Kalyanpur Police Station Case No. 11 of 2018.
