JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 448/34 of the Indian Penal Code. The prosecution case is of abusing the informant and making assault.

It is submitted by learned counsel for the petitioner that specific accusation of assault is against coaccused Suresh Sah with spear and co-accused Gajadhar Sah with lathi when the accusation is omnibus and general against the petitioner. Altogether nine injuries have been found but all have been found to be simple in nature.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the accusation being omnibus and general, injuries being found simple and petitioner having no criminal antecedent, let the petitioner, above named, in the

Case No. 8 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
